Terms of Service

1. Acceptance of Terms

By accessing and using Watermark Remover AI ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Watermark Remover AI is an AI-powered photo editing service that allows users to:

  • Upload a single JPG, PNG or WebP image up to 50 MB
  • Automatically remove overlaid watermarks with AI and review reconstructed backgrounds
  • Download generated results while their links remain available
  • Use free credits, purchase credit packs, or subscribe for a recurring credit allowance

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 13 years old to create an account
  • One person or legal entity may maintain no more than one account

3.2 Account Responsibility

  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these terms

4. Acceptable Use

4.1 Permitted Uses

  • Personal and commercial photo editing
  • Creating content for marketing, social media, and creative projects
  • Educational and research purposes

4.2 Prohibited Uses

You may NOT use our service to:

  • Upload or process image files containing illegal, harmful, or offensive content
  • Create deepfakes or misleading content without proper disclosure
  • Process image files of people without their consent
  • Generate content that violates intellectual property rights
  • Remove watermarks, logos, signatures, or ownership notices without the rights or permission needed to do so
  • Create content for harassment, discrimination, or hate speech
  • Attempt to reverse engineer or copy our AI models
  • Use automated tools to abuse our service or exceed rate limits

5. Subscription Plans and Payments

5.1 Free Plan

  • New accounts created with Google receive 5 free credits. Email registration does not include a sign-up bonus.
  • The homepage guest editor currently offers 5 free credits per calendar month, subject to guest and IP-based usage limits
  • Each standard watermark removal uses 5 credits; downloads are included

5.2 Paid Plans

  • One-time credit packs and monthly or annual subscriptions are available; prices and allowances are shown at checkout
  • Subscriptions renew automatically unless canceled before the next renewal
  • Subscription credits reset to the plan allowance each month, including on annual plans; unused subscription credits do not roll over and expire when the subscription ends
  • Credits from one-time purchases do not expire; subscription credits are used before permanent credits
  • Checkout payments are processed through Stripe
  • Refunds are subject to the Cancellation and Refunds policy below

5.3 Cancellation and Refunds

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • You may request a full refund within 30 days of your first purchase if none of the paid credits from that order have been used
  • Renewals, orders with used paid credits, and partial billing periods are generally non-refundable. Cancellation does not automatically issue a refund
  • To request a refund or report a billing error, email [email protected] with your account email and order ID. Billing errors, including duplicate charges, are reviewed individually
  • Your statutory refund rights are unaffected by this policy

6. Intellectual Property

6.1 Your Content

  • You retain any rights you hold in the files you upload
  • You grant Watermark Remover AI and its service providers the limited permission needed to store and process your files and instructions to provide the requested service
  • You may use generated results subject to applicable law, third-party rights, and the terms of the model or service provider used; we do not guarantee exclusive rights or copyright protection
  • You are responsible for having the rights and consent needed to upload, edit, and use the content

6.2 Our Service

  • Watermark Remover AI retains rights in its own website, branding, and original service code; third-party models and technologies remain subject to their owners' rights and licenses
  • Our service is protected by applicable intellectual property laws
  • You may not copy, modify, or reverse engineer protected parts of the service except as permitted by law

7. Service Availability and Limitations

  • We may temporarily suspend service for maintenance or updates
  • Processing times may vary based on server load and file size
  • We reserve the right to implement usage limits to ensure fair access
  • Some features may be in beta and subject to changes or removal

8. Privacy and Data Protection

Your privacy is important to us. Our data handling practices are detailed in our Privacy Policy, which forms part of these terms. Key points include:

  • Images are stored in Cloudflare R2 and processed by the AI provider. We do not currently promise automatic deletion after a fixed period; account, billing, task and log records are stored separately
  • Photos are stored in Cloudflare R2, and photos and editing instructions are sent to Replicate to provide the requested service
  • Third-party providers apply their own data handling and retention terms; account, billing, task and log records are stored separately
  • Our Privacy Policy explains the information handled by the service

9. Disclaimers and Limitation of Liability

IMPORTANT LEGAL NOTICE:

  • Our service is provided "as is" without warranties of any kind
  • We do not guarantee the accuracy, quality, or suitability of edited images
  • We are not liable for any damages arising from use of our service
  • Our total liability is limited to the amount you paid for the service
  • You use our service at your own risk

10. Termination

We may terminate or suspend your account and access to the service at our sole discretion, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive termination.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through our service. Continued use of the service after changes constitutes acceptance of the new terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of China, without regard to its conflict of law provisions.

Any disputes arising from these terms or use of our service shall be resolved through binding arbitration in accordance with the rules of Chinese law.
